Hello Support provides digital marketing services to support your brand’s visibility, engagement, and lead generation. However, we make no guarantees regarding specific financial outcomes, business growth, return on investment (ROI), or campaign performance. Marketing results depend on multiple factors outside our control, including market conditions, consumer behavior, competitor actions, and your internal sales processes. We are not responsible for your financial performance or any losses incurred.
2. Third-Party Platforms and Decisions
Hello Support operates independently of third-party platforms (e.g., Google, Facebook, Instagram, LinkedIn, TikTok). We have no control over platform decisions related to algorithm changes, ad approvals or disapprovals, account suspensions or terminations, policy updates, or outages. We are not liable for negative impacts from these external decisions.
3. Payment Terms and Billing Policy
Hello Support operates on automatic recurring monthly billing through Stripe, our payment
processing provider. Clients agree to be enrolled in 30-day automatic recurring payments. Hello Support does not manually request or chase down payments. Payment is required for services to continue, and any lapses or failed payments may result in an immediate pause of services and account access. For cancellation, clients must follow the 30-day notice policy as outlined in the Termination section.
4. Communication and Dispute Resolution
The client agrees to notify Hello Support in writing of any concerns or disputes within 10 business days of identifying an issue. Until disputes are fully resolved, Hello Support is not obligated to provide services, account access, or asset control and may pause campaigns or restrict access to protect both parties. Initiating chargebacks or withholding payments without prior communication and
resolution efforts constitutes a breach of agreement.
5. Intellectual Property & Account Ownership
Client-Owned Assets: Ad accounts, websites, domains, and creative assets created for the client remain client-owned, assuming no unresolved disputes or unpaid balances. Upon termination—and provided no disputes or financial obligations remain—Hello Support will transfer full control of these assets. Hello Support Proprietary Materials: Certain internal systems, strategies, workflows, templates, and tools remain exclusive property of Hello Support. These proprietary materials will never be transferred or disclosed, ensuring our ability to consistently deliver quality services.
6. Limitation of Liability
Hello Support’s total liability for any claims relating to services provided is strictly limited to the lesser of one (1) month of fees paid by the client or $10,000. Hello Support shall not be liable for indirect, incidental, consequential, punitive, or special damages, including lost profits or data loss, even if advised of such possibilities.
7. Force Majeure
Hello Support is not liable for delays or failures in service caused by events outside our control, including but not limited to natural disasters, acts of government, pandemics, labor disputes, power outages, or platform outages. Services will resume as soon as reasonably possible after such events.
8. Client Cooperation
The client agrees to provide timely approvals, access, and information necessary for Hello Support to deliver services. We are not responsible for delays or performance issues caused by client inaction or delayed responses.
9. Confidentiality
Both Hello Support and the client agree to maintain the confidentiality of any proprietary or sensitive information exchanged during the engagement for two (2) years after termination. This excludes information that becomes public through no fault of either party, is independently developed, or must be disclosed by law.
10. Termination
Either party may terminate services with 30 days’ written notice. Hello Support reserves the right to terminate services immediately if the client breaches this Disclaimer, engages in unethical or unlawful behavior, or initiates chargebacks without following the dispute process. Upon termination, access to services and accounts will follow the Intellectual Property & Account Ownership guidelines.
11. Jurisdiction
This Disclaimer is governed by the laws of the State of Arizona. Any disputes shall be resolved exclusively in the state or federal courts of Phoenix, Arizona, and the client consents to their jurisdiction.
12. Amendments
Hello Support may update this Disclaimer at any time. Continued engagement with our services constitutes acceptance of the updated terms.
